Swisscontact is recruiting a national consultant for the Swiss PartnershIP Morocco project, a development cooperation project between the Swiss and Moroccan governments. It is funded by the Swiss State Secretariat for Economic Affairs (SECO) and implemented by the Swiss Federal Institute of Intellectual Property (IPI). The IPI has mandated the Swisscontact Foundation in Morocco to handle local administrative procedures, which include this consultant mandate.
Within its component focused on improving IP legislation and strategies, the Swiss PartnershIP Morocco project aims to contribute to a better framework for investment and innovation.
Furthermore, sub-outcome A-1 of the project stipulates that: “Laws and regulations concerning industrial property are updated.”
To achieve this objective, the Moroccan Office of Industrial and Commercial Property (OMPIC), as the project's main partner, wishes to recruit a national consultant to carry out the following activities:
Analysis of expectations and best practices in the field of industrial property, particularly for the four priority areas defined by OMPIC.
Impact and feasibility study of new procedures and mechanisms to be introduced, such as utility models, provisional applications, and administrative procedures.
Drafting of proposed legal texts for adoption.
Purpose of the mandate
The consultant must conduct and produce feasibility study reports for the areas of amendment identified by OMPIC and reports on international best practices in industrial property in the areas defined by OMPIC.
The consultant must be able to translate the expected results and objectives of the amendment into draft legislative and regulatory texts that meet the needs expressed by the OMPIC (Moroccan Office of Industrial and Commercial Property). They must also develop a matrix containing the proposed amendments, the objective of each amendment, and the references, sources, and arguments that justified the proposed changes.
The consultant will analyze the current legal framework and formulate recommendations for improvement, particularly through feasibility and impact studies (e.g., utility models, provisional requests, administrative procedures). They will then draft amendment proposals and amendment matrices (objectives, references, sources, arguments), ensuring the consistency, clarity, and applicability of the texts, especially for Law No. 17-97 and its implementing regulations.
Main expected deliverables
Initial summary report (needs, international standards, best practices)
Comprehensive impact assessment (scenarios, recommendations, expected objectives)
Compliance study with ratified treaties/agreements and applicable legislation
Drafting of amendment provisions and associated matrices.
Desired profile
Law degree, specializing in IP/commercial law;
At least 10 years of experience in IP (including legislative analysis, impact assessments, legislative drafting), with references for similar assignments (ideally in international cooperation);
Good knowledge of relevant international treaties; ability to write and present in French and Arabic; ability to work with public institutions and in a multidisciplinary environment.
